1. Acceptance of Terms

By accessing, registering for, or purchasing services from PowerProxy ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our platform or services. These Terms apply to all visitors, users, account holders, and purchasers of our mobile proxy services.

2. Account Registration & Security

You must be at least 18 years old or the age of majority in your jurisdiction to create an account. You agree to:

• Provide accurate, complete, and up-to-date registration information.
• Maintain the confidentiality of your login credentials and account activity.
• Accept responsibility for all actions that occur under your account.
• Notify us immediately of any unauthorized use or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

3. Proxy Services & Delivery

Upon successful payment and account verification, we will provision mobile proxy access according to your selected subscription tier. Your account will include access to our secure client dashboard, where you can manage:

• Authentication & Connectivity: Secure proxy credentials (IP/Port or Username/Password) and OpenVPN profile generation for secure tunneling.
• IP Rotation & Modem Management: Configurable automatic IP rotation, manual IP reset functionality, detailed rotation history logs, modem reboot options, and real-time external IP verification.
• Port & Bandwidth Controls: Real-time bandwidth usage monitoring, bandwidth counter resets, IP whitelisting for restricted access, and OS spoofing configuration per port.
• Subscription & Billing Management: Auto-renewal toggling, subscription extension/renewal workflows, service management request submission, and automated invoice generation/download.

Feature availability, bandwidth allocations, rotation limits, and modem/port controls are determined by your active subscription plan and network capacity. All dashboard actions are subject to platform rate limiting to ensure system stability and fair usage. We do not guarantee uninterrupted, error-free, or latency-free proxy performance.

4. Acceptable Use Policy

Our proxy services must not be used for illegal, abusive, or harmful activities. You strictly agree not to use our proxies for:

• Fraud, phishing, identity theft, or financial scams
• Spamming, bulk email abuse, or violating CAN-SPAM/GDPR/anti-spam laws
• Unauthorized access, hacking, DDoS attacks, or circumventing security measures
• Copyright infringement, pirated content distribution, or DMCA violations
• Illegal scraping, botting that violates third-party Terms of Service, or manipulating markets
• Distributing malware, ransomware, or engaging in cybercrime

We actively monitor for abuse. Violations will result in immediate suspension, termination, and forfeiture of unused service time. We cooperate fully with law enforcement when required.

5. Payments, Billing & Refunds

• Subscriptions: Recurring plans auto-renew until canceled. Cancellations take effect at the end of the current billing cycle.
• Refund Policy: Refunds are issued only in accordance with our published refund policy and applicable consumer laws. Partial refunds may apply for unused service periods at our discretion.
• Chargebacks: Unauthorized chargebacks may result in immediate account termination, service suspension, and collection of owed amounts.
• Pricing Changes: We reserve the right to adjust pricing with advance notice. Existing active plans remain at the purchased rate until renewal.

6. Service Availability & Modifications

We strive to maintain high uptime but do not guarantee 100% service availability. Planned maintenance, network upgrades, or force majeure events may cause temporary interruptions. We may modify, upgrade, or discontinue features or pricing tiers with reasonable notice. Continued use after changes constitutes acceptance.

7. Intellectual Property

All content, branding, software, dashboard interfaces, documentation, and proxy infrastructure provided by PowerProxy are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the services for personal or business purposes in compliance with these Terms.

8. Limitation of Liability

To the maximum extent permitted by law, PowerProxy and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination & Suspension

We reserve the right to suspend or terminate your account and access to services at any time, with or without cause, including but not limited to: violation of these Terms, Acceptable Use Policy, non-payment, or legal/regulatory requirements. Upon termination, you remain liable for all outstanding fees.

10. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of our services shall be resolved exclusively in the competent courts of Amsterdam, Netherlands. You waive the right to participate in class actions or jury trials to the extent permitted under Dutch law.

11. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email, dashboard notification, or website banner. Continued use after updates constitutes acceptance. We encourage you to review this page regularly.
